TERMS + CONDITIONS
for portrait and event photography
PLEASE READ THOROUGHLY AND CAREFULLY, AS THIS WILL BE OUR "AGREEMENT" UPON BOOKING
For the purposes of this agreement, "the CLIENT" is the party commissioning CRISTINAJANEE photography & design, (referred to as the Photographer).
Upon submitting payment for a proposed invoice, You, the CLIENT, agree to all of the terms that follow.
DEPOSIT AND PAYMENT
The CLIENT agrees that a portion of the total payment is non-refundable and non-transferable in the event of cancellation or postponement by the CLIENT for any reason except in case of death or serious illness to the CLIENT. Such cancellation must be in writing and a registered professional must attest to the reason referenced for cancellation in order to receive a full refund.
At such time as the session is completed, any additional services or images requested will be invoiced and the CLIENT will pay the balance due upon receipt, and before any additional services or images are provided. If the CLIENT refuses to pay according to the agreed upon payment schedule, CLIENT will be in default and shall pay 3% interest on the balance until payment is made in full.
TIMELINESS + ATTENDANCE
All CLIENTS are asked to arrive 5 minutes prior to session, dressed (including hair and makeup) and ready to shoot.
Timeliness is imperative for the smooth execution of each session. The session clock will start at the agreed upon time, and additional time will not be added to a session in the event of tardiness.
A $20 late fee will be assessed if the CLIENT is between 15-25 minutes late. If the CLIENT is more than 25 minutes late, the session will be cancelled and all fees are non refundable and non transferable.
TERMINATION
The CLIENT agrees that this Agreement shall be deemed terminated if all monies are not paid on time as stipulated in the description of this Agreement and the Photographer shall have no further obligations to the CLIENT.
COMPLETION SCHEDULE
Digital proofs of the images captured during the session will be available in an online gallery within 7 days of the session date. Turnaround can possibly be expedited (for an additional fee) upon request, but can only be guaranteed if communicated to and confirmed by the Photographer before the session is booked.
When client selection is applicable, the CLIENT is required to choose the images they wish to include in the photography package within 14 days from delivery of the proofs. If CLIENT fails to indicate their preference, the photographs will be chosen by the Photographer.
COPYRIGHT AND REPRODUCTIONS
The Photographer shall own the copyright in all images created and shall have the right to make reproductions for the CLIENT or for the Photographer's portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, or for display on the Photographer's website(s). If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client.
CLIENT’S USAGE
The CLIENT is granted unlimited but non‐exclusive rights to use the images which the CLIENT pays for, for non-commercial use. CLIENT is purchasing images as indicated on the Photographer’s Standard Price List. CLIENT may not resell or significantly alter any digital images and/or prints without the express written consent of the Photographer.
FAILURE TO PERFORM
If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, then the Photographer will refund the CLIENT in full and will have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the CLIENT‘S order.
EXCLUSIVE PHOTOGRAPHER
The Photographer will be the exclusive photographer retained by the CLIENT for the purpose of photographing the event or session.
The Photographer may substitute another photographer to take the photographs in the event of Photographer’s illness or of scheduling conflicts. In the event of such substitution, Photographer warrants that the photographer taking the photographs shall be a competent professional. PHOTOGRAPHER’S STANDARD PRICE LIST
The charges in this Agreement are based on the Photographer’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
APPLICABLE LAW
This Agreement incorporates the entire understanding of the parties and shall be governed by the laws of the State of Texas.
