TERMS + CONDITIONS
for real estate photography services
PLEASE READ THOROUGHLY AND CAREFULLY, AS THIS WILL BE OUR "AGREEMENT" UPON BOOKING
For the purposes of this agreement, "the CLIENT" is the party commissioning CRISTINAJANEE photography & design, (referred to as the Photographer).
Upon submitting payment for a proposed invoice, You, the CLIENT, agree to all of the terms that follow.
PAYMENT AND DELIVERY SCHEDULE
Payment for real estate photography services is due prior to the start of the photoshoot. The Photographer agrees to deliver final images digitally within 24 to 48-hours of the fully paid, completed photoshoot.
If other payment arrangements are requested, they must be made in writing at least 48-hours before the scheduled photoshoot and are at the discretion of the Photographer. In some arrangements payment may be made after services but before final image delivery, in which case, the Photographer agrees to deliver final images digitally within 24 to 48-hours of receipt of full payment.
PROPERTY CONDITION
The CLIENT will ensure that the property is clean and ready for photography at the scheduled photoshoot start time. The Photographer is not responsible for cleaning, dusting, changing lightbulbs or moving of furniture but may adjust window coverings, move small items, or turn on/off lights as deemed necessary. The CLIENT shall ensure that there are no hazards to the Photographer's safety and that pets are confined out of view. The Photographer will not retouch images to disguise known defects and/or physical structures such as wall/floor blemishes, driveway cracks, power lines, etc.
TERMINATION AND CANCELLATIONS
The CLIENT agrees that this Agreement shall be deemed terminated if all monies are not paid on time as stipulated in the description of this Agreement and the Photographer shall have no further obligations to the CLIENT.
Cancellations by the CLIENT must be made at least 24-hours before the scheduled photoshoot start time. Real Estate Photoshoots cancelled with less than 24-hours notice will be subject to a cancellation fee of $50. Once the Photographer has arrived at a property, the order may be canceled, however there will be no refund.
WEATHER CONDITIONS
Weather-related cancellations are subject to the terms above. If the scheduled photoshoot has to be postponed due to inclement weather, in which it is deemed unsafe or unreasonable to travel, no additional fee will be charged.
Some weather conditions can adversely effect exterior home photo quality. In the event of unfavorable weather in which travel is still feasible, the interior photos will be photographed as planned. Alternate arrangements can be made for the exterior and additional fees may apply unless full cancellation is made at least 24-hours in advance.
When weather is dry but blue skies are not present the Photographer can provide one (1) blue sky replacement on the primary exterior home photo at no additional charge.
COPYRIGHT AND REPRODUCTIONS
The Photographer retains the copyright for all digital images created in the course of doing business. The CLIENT is granted license to use property images, for which they have paid, for the promotion of that property in any media while CLIENT manages the listing. License expires once the property listing has Sold, Expired or is Withdrawn. Images cannot/will not be made available to another agent who takes over an expired or withdrawn listing. Images must not be edited/altered by anyone other than the Photographer with the exception of minor cropping and/or resizing only. Unauthorized use of images is a copyright violation, and will result in termination of this contract.
FAILURE TO PERFORM
If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, then the Photographer will refund the CLIENT in full and will have no further liability with respect to the Agreement. In the event the Photographer fails to perform for any other reason, the Photographer will not be liable for any amount in excess of the retail value of the CLIENT‘S order.
PHOTOGRAPHER’S STANDARD PRICE LIST
The charges in this Agreement are based on the Photographer’s Standard Price List. This price list is adjusted periodically and future orders shall be charged at the prices in effect at the time when the order is placed.
APPLICABLE LAW
This Agreement incorporates the entire understanding of the parties and shall be governed by the laws of the State of Texas.
